Please read these terms carefully before using TheWineAI.
1. Acceptance of terms
By accessing or using TheWineAI ("the Platform"), you agree to these Terms and Conditions.
If you do not agree to these Terms, do not use the Platform.
These Terms apply to all users, including visitors, registered users, wine lovers, wine farms, business users, event organisers, and any person who submits content to the Platform.
2. Eligibility
You must be at least 18 years old to use TheWineAI.
By accessing, browsing, registering, or using the Platform, you confirm that you are 18 years or older and legally permitted to view alcohol-related content.
We may suspend or terminate access if we believe a user is under 18 or has provided false age information.
3. Responsible alcohol consumption
The Platform provides information about wine and alcoholic beverages.
TheWineAI promotes responsible alcohol consumption.
Do not drink and drive. Use a designated driver, ride-hailing service, shuttle, public transport, or other safe transport option.
Users are responsible for complying with all laws relating to the purchase, possession, consumption, transport, and use of alcoholic beverages.
Nothing on the Platform should be interpreted as encouraging excessive or irresponsible alcohol consumption.
4. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must provide accurate, current, and complete registration information and keep it up to date.
You may not create an account using false details, another person’s identity, or information you are not authorised to use.
We may suspend, restrict, or terminate accounts that violate these Terms, create legal risk, harm other users, misuse the Platform, or breach applicable law.
5. Platform purpose
TheWineAI is a wine discovery, recommendation, listing, route-planning, and information platform.
The Platform may display wine farms, wines, tasting experiences, events, routes, reviews, images, recommendations, and related content.
Unless expressly stated otherwise, TheWineAI is not the seller, supplier, manufacturer, distributor, organiser, host, agent, broker, or representative of any wine farm, wine producer, venue, event organiser, or third-party service provider listed on the Platform.
6. Use by wine lovers
Recommendations, routes, wine information, tasting information, food pairing suggestions, and farm suggestions are provided for discovery and informational purposes only.
Wine availability, prices, vintages, stock, menus, tasting fees, event details, opening hours, images, descriptions, and venue information may change without notice.
You are responsible for verifying important information directly with the relevant wine farm, venue, organiser, retailer, or service provider before travelling, booking, purchasing, or relying on it.
7. AI-generated recommendations
Wine recommendations, tasting notes, food pairings, route suggestions, descriptions, rankings, and personalised content may be generated, ranked, or assisted by artificial intelligence systems.
AI-generated content may contain errors, omissions, outdated information, or subjective suggestions.
AI recommendations do not constitute professional, legal, financial, medical, health, nutritional, safety, travel, or purchasing advice.
You should independently verify important information before relying on it.
8. Wine farm listings
Wine farms, producers, venues, and business users are responsible for the accuracy, legality, completeness, and currency of their listings, images, descriptions, wines, tasting options, prices, events, contact details, operating hours, and promotional content.
Farm users must ensure that all submitted content complies with applicable liquor, advertising, consumer protection, intellectual property, privacy, and other laws.
New farms may require verification by TheWineAI before appearing in public directories.
We may approve, reject, edit, remove, suspend, or restrict listings that are inaccurate, misleading, unlawful, harmful, outdated, offensive, infringing, or otherwise unsuitable for the Platform.
Publication on the Platform does not imply endorsement, certification, partnership, agency, or guarantee by TheWineAI.
9. Alcohol and liquor law compliance
Wine farms, producers, venues, event organisers, advertisers, and business users are solely responsible for holding all licences, registrations, approvals, permits, and authorisations required by applicable liquor laws.
Users and business users must not use the Platform to advertise liquor in a false or misleading way or in a way intended to target or attract minors.
Users and business users must not use the Platform to sell, supply, promote, or arrange the unlawful sale or supply of liquor to minors.
TheWineAI may remove content or suspend access where we believe alcohol-related laws, advertising restrictions, responsible drinking standards, or these Terms may be breached.
10. Events and farm visits
TheWineAI may display information about wine tastings, farm visits, festivals, launches, pairings, private events, and other activities.
Event details may be supplied by farms, venues, organisers, or third parties and may change without notice.
Attendance at any event, tasting, venue, or farm visit is at your own risk.
TheWineAI is not responsible for cancellations, postponements, refunds, injuries, losses, damages, venue conditions, intoxication, transport issues, weather, availability, capacity limits, accessibility issues, or any other matter arising from third-party events or farm visits.
11. Route planning
Route planning, map, location, and geocoding features are provided for convenience only.
Routes may be inaccurate, incomplete, delayed, unavailable, unsafe, or unsuitable due to road conditions, traffic, closures, weather, map errors, farm opening hours, or other factors.
You are responsible for verifying directions, distances, travel times, road conditions, legal driving limits, transport arrangements, opening hours, bookings, and safety considerations.
TheWineAI is not responsible for navigation errors, accidents, fines, delays, losses, damages, or injuries arising from route recommendations or map features.
12. Reviews, ratings, and user content
Users may be able to submit ratings, reviews, comments, photographs, profile content, farm content, event content, and other materials.
You are responsible for all content you submit.
You must not submit content that is unlawful, false, misleading, defamatory, abusive, hateful, discriminatory, obscene, threatening, harassing, invasive of privacy, infringing, spam, or otherwise harmful.
You must not submit reviews in exchange for undisclosed payment, incentives, gifts, discounts, or benefits.
We may moderate, edit, remove, refuse, hide, or restrict user content at our discretion, but we are not obliged to monitor all content.
13. Licence to user content
You retain ownership of content you submit, subject to rights granted to us under these Terms.
By submitting content to the Platform, you grant TheWineAI a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, publish, distribute, modify, format, adapt, promote, and use the content for the purpose of operating, improving, marketing, and promoting the Platform.
You warrant that you have all rights, permissions, licences, and consents required to submit the content and grant this licence.
14. Prohibited conduct
You must not:
- Use the Platform for unlawful, fraudulent, harmful, or misleading purposes
- Access or use the Platform if you are under 18
- Misrepresent your identity, age, business, authority, affiliation, or location
- Attempt unauthorised access to accounts, systems, APIs, databases, or infrastructure
- Scrape, crawl, harvest, copy, or extract Platform data at scale without written permission
- Reverse engineer, interfere with, overload, disrupt, bypass, or compromise the Platform
- Upload malware, harmful code, spam, fake reviews, or automated abuse
- Use the Platform to target minors with alcohol-related content
- Submit content that infringes intellectual property, privacy, personality, or other rights
- Use recommendations or route features in a way that creates a safety risk
15. Third-party services
The Platform may integrate with or link to third-party services, including Google Maps, geocoding services, hosting providers, Dodo Payments, email providers, analytics tools, social media platforms, booking platforms, and wine farm websites.
Third-party services are subject to their own terms, policies, availability, pricing, limits, and data practices.
We are not responsible for third-party services, websites, content, failures, outages, delays, charges, errors, or losses.
16. Paid features, subscriptions, and billing
TheWineAI offers paid farm listing subscriptions and may offer other paid features from time to time.
Farm subscriptions are billed monthly in United States dollars (USD) through Dodo Payments, our payment provider. Checkout and recurring billing are completed on Dodo’s hosted payment pages or through Dodo’s subscription management flows. TheWineAI does not collect or store your full card number.
The subscription price, billing interval, and any applicable taxes or fees are shown before you complete checkout or activate a subscription.
You are responsible for providing accurate billing and contact information and for paying all applicable fees on time.
Self-service farm registration requires completing checkout (unless a site-wide free trial applies). Until payment is complete, your farm may remain unverified and excluded from public listings.
When a promotional free trial ends or a farm is moved to a paid plan, a grace period may apply before non-payment results in suspension of public listing visibility. Grace reminders may be sent by email.
You may cancel an active farm subscription at the end of the current billing period from your farm billing page. Unless we suspend access earlier for other reasons under these Terms, your subscription remains active until the end of the paid period.
Refunds, chargebacks, failed payments, and payment disputes are handled according to Dodo Payments’ policies and applicable law. We may suspend or restrict paid features, public listing visibility, or access if payment fails, is reversed, is disputed, or remains unpaid after any applicable grace period.
Payment history and subscription status shown in the Platform are provided for convenience. Dodo Payments’ records govern billing disputes with the payment provider.
17. Consumer protection
Nothing in these Terms is intended to exclude, restrict, or limit any rights you may have under applicable consumer protection laws that cannot legally be excluded.
Where the Platform displays third-party products, events, tastings, prices, or services, the relevant farm, venue, seller, organiser, or service provider remains responsible for its own offering unless TheWineAI expressly states otherwise.
18. Intellectual property
TheWineAI branding, software, source code, designs, layouts, databases, recommendation systems, original content, trademarks, logos, and Platform materials are owned by us or our licensors.
You may not copy, reproduce, modify, distribute, sell, licence, reverse engineer, scrape, or exploit any part of the Platform without written permission, except as allowed by law.
Farm logos, farm images, wine labels, trademarks, and third-party content remain the property of their respective owners.
19. Intellectual property complaints
If you believe that content on the Platform infringes your intellectual property rights, contact us with enough information to identify the content, prove ownership or authority, and explain the alleged infringement.
We may remove or restrict content while investigating intellectual property complaints.
20. Availability and changes
The Platform may be unavailable, interrupted, delayed, changed, suspended, or discontinued at any time.
We may modify, remove, replace, or restrict features, content, listings, recommendations, routes, pricing, or services without notice.
We do not guarantee uninterrupted, secure, accurate, complete, or error-free operation of the Platform.
21. Disclaimers
The Platform is provided "as is" and "as available" to the fullest extent permitted by law.
We do not guarantee that wine information, tasting notes, farm details, prices, opening hours, event details, route information, recommendations, availability, images, or third-party content will be accurate, complete, current, lawful, safe, or suitable.
You use the Platform, recommendations, listings, routes, and third-party information at your own risk.
22. Limitation of liability
To the fullest extent permitted by law, TheWineAI, its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or economic losses arising from your use of the Platform.
This includes loss of profits, loss of data, loss of goodwill, business interruption, travel costs, wasted expenditure, reputational harm, injury, accidents, third-party disputes, event issues, farm visit issues, or reliance on inaccurate information.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
23. Indemnity
You agree to indemnify and hold harmless TheWineAI, its owners, employees, contractors, affiliates, and service providers from claims, losses, damages, liabilities, penalties, costs, and expenses arising from your use of the Platform, your content, your business listing, your breach of these Terms, your breach of law, or your infringement of any third-party rights.
24. Termination
You may stop using the Platform at any time.
We may suspend, restrict, or terminate access to the Platform or any account, listing, subscription, content, or feature if we believe there has been a breach of these Terms, legal risk, security risk, abuse, non-payment, or conduct harmful to the Platform, users, farms, or third parties.
Termination does not affect rights, obligations, or liabilities that arose before termination.
25. Force majeure
TheWineAI will not be liable for delays, interruptions, failures, or losses caused by events beyond our reasonable control, including natural disasters, power failures, internet outages, hosting failures, cyberattacks, labour disputes, government action, legal restrictions, war, civil unrest, pandemics, third-party service failures, or failures of farms, venues, payment providers, or mapping providers.
26. Privacy
Your use of the Platform is also governed by our Privacy Policy and Cookie Notice.
By using the Platform, you acknowledge that we process personal information as described in those documents.
27. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change when we do.
Material changes may be communicated through the Platform, by email, or by other reasonable means.
Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
28. Governing law
These Terms are governed by the laws of the Republic of South Africa.
Disputes are subject to the jurisdiction of South African courts unless otherwise required by mandatory law.
